Purpose and scope
These general terms and conditions of sale (the “Terms”) govern the sale of products on the HYPE&CLUB website between [Company name], [legal form] with a share capital of €[amount], whose registered office is located at [registered office address] (“HYPE&CLUB”), and any natural person acting as a consumer (the “Customer”).
Placing an order implies full acceptance of these Terms, which the Customer acknowledges having read before confirming the order. The applicable Terms are those in force on the date of the order. In case of discrepancy between the French and English versions, the French version prevails.
- 02
Products
Products are described and presented as accurately as possible on their product page (features, pack contents, size guide). Photographs are not contractual.
HYPE&CLUB compression therapy boots are wellness and recovery devices. They are not intended to diagnose, treat or prevent any disease. The precautions for use stated on the product page and in the manual must be followed; in case of a circulatory disorder, heart condition, pregnancy, wound or infection on the legs, medical advice is required before any use.
Offers are valid while stocks last.
- 03
Prices
Prices are shown in euros, including all taxes (French VAT applicable on the day of the order), excluding shipping costs. Shipping costs and the total amount payable are shown to the Customer on the payment page, before the order is confirmed.
HYPE&CLUB reserves the right to change its prices at any time; products are invoiced at the price in force when the order is confirmed.
- 04
Ordering
The Customer selects the products and, where applicable, their size, then adds them to the cart. From the cart, the Customer is taken to a secure payment page to enter their contact details and delivery address, choose a delivery method and check the details and total price of the order before confirming it. No account is required to order.
Confirming the order constitutes acceptance of these Terms and an obligation to pay. A confirmation email summarising the order and its number is sent to the Customer at the address provided.
HYPE&CLUB reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding payment of a previous order, or in the event of an abnormal order or one placed in bad faith.
- 05
Payment
Payment is due immediately upon ordering. It is made on a secure payment page, by bank card or by the other methods offered on that page. Card payments are processed by the payment provider Stripe; the Customer’s card details are encrypted and are never transmitted to or stored by HYPE&CLUB.
The order is final only once the payment has been confirmed by the bank.
- 06
Delivery
Products are delivered to the address provided by the Customer when ordering, within the areas offered on the payment page: [delivery areas].
Delivery methods, carriers and the corresponding costs are shown on the payment page. Orders are shipped within [preparation time] working days of payment confirmation; the indicative delivery time is [delivery time] working days after shipping. A tracking number is emailed to the Customer as soon as the order ships.
If the order is not delivered within the stated time, or at the latest within thirty days of the order, the Customer may cancel the sale under the conditions set out in articles L. 216-6 et seq. of the French Consumer Code.
The Customer should check the condition of the parcel on receipt and report any issue (damaged parcel, missing product) to the carrier and to HYPE&CLUB as soon as possible.
- 07
Right of withdrawal
In accordance with articles L. 221-18 et seq. of the French Consumer Code, the Customer has fourteen days from receipt of the product to exercise their right of withdrawal, without having to give any reason or pay any penalty.
To do so, the Customer informs HYPE&CLUB of their decision by an unambiguous statement, by email to [contact email address] or via the website’s contact form, stating their order number. The Customer then returns the product no later than fourteen days after communicating their decision, to the address provided: [return address].
The product must be returned complete (boots, controller, charger, bag, accessories and manual), in its original packaging and in good condition. The Customer is liable for any loss in value of the product resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning. Return costs are borne by the Customer [to be confirmed].
HYPE&CLUB refunds all sums paid, including the initial delivery costs (based on the standard delivery method), no later than fourteen days after being informed of the Customer’s decision, using the same means of payment as for the order. The refund may be withheld until the product has been received or proof of its return has been provided.
- 08
Legal guarantees
Products are covered by the legal guarantee of conformity (articles L. 217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
Under the legal guarantee of conformity, the Customer has two years from delivery of the product to take action. The Customer may obtain repair or replacement of the product or, failing that, a price reduction or cancellation of the sale. Lack of conformity appearing within this period is presumed to have existed at the time of delivery, unless proven otherwise.
Under the guarantee against hidden defects, the Customer may choose between cancellation of the sale or a price reduction, within two years of discovering the defect.
To make a claim under a guarantee, the Customer contacts HYPE&CLUB at [contact email address], stating the order number and the nature of the defect.
- 09
Liability
HYPE&CLUB cannot be held liable for damage resulting from use of the product that does not comply with its manual or precautions for use, nor for non-performance of the contract attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to force majeure.
- 10
Personal data
The personal data collected when ordering is necessary to process and deliver the order. Its processing is described in the website’s privacy policy.
- 11
Customer service and complaints
For any question or complaint, the Customer can contact HYPE&CLUB by email at [contact email address] or via the website’s contact form. HYPE&CLUB endeavours to reply as soon as possible.
- 12
Mediation and governing law
These Terms are governed by French law.
In the event of a dispute, the Customer first sends a written complaint to HYPE&CLUB. If no amicable solution is found, the Customer may refer the matter, free of charge, to the consumer mediator to which HYPE&CLUB belongs: [name, address and website of the consumer mediator], in accordance with articles L. 612-1 et seq. of the French Consumer Code.
Failing an amicable solution, the dispute shall be brought before the competent courts under ordinary law.
